On August 16 today, Jung Kyu Jae TV released the audio recording files of Ko Young-tae and his aides on the YouTube channel. He said, 'It was a conspiracy of Ko Young–tae and his cronies to seize the K Sports Foundation, not a Choi Soon-sil scandal  or Choi Soon-sil' s interference in state affairs. 'Ko Young-tae' s cronies  seem to have something to do with politically assassinating Park Geun-hye. '

Now let us show you the contents of some of the 2,300 transcripts that we have read. We have caught the audio recording showing that the cronies of Ko Young-tae decided to give a fatal blow to President Park and take over the K-Sports Foundation." In addition, through the recording of the call, it is proved that President Park was not involved incorruption in relation to the K Sports Foundation. The media was fed with fake news cooked up by the cronies. Even though the prosecutors have secured 2,300 audio files, Mr. Jung said, the prosecutor followed the view that the president was corrupt as told by the cronies."

The telephone call recordings that were released on Jung Kyu Jae TV are of the conversations of Ryu Sang-young, former director of The Blue K and former CEO of Goun Planning and were recorded on January 24, 2016. Jung Kyu-jae said that through the recordings of Ko Young-tae's telephone conversations, which are being broadcast in his show today, it is proven that the President is not corrupt.

So, let's go over the telephone transcript of the recording files of the regular TV broadcast today.

As we build the network, and by bringing the money in the foundation to us quickly ... So therefore, the prosecutor….we are placing our man under the chief prosecutor in the anti-corruption team to give direction. Launch a massive investigation on the sports industry before the end of this regime. 

To get rid of all the corrupt corporations and the big foundations and associations will send out orders to wash all the plates clean. After we consume 70 billion Korean Won little by little, in secret, and launch an investigation to reset everything. This setup will go on for a long time. 

We are being more strategic. We have the power and we are wielding that power. We report to the anti-corruption prosecutor and really shake up the sports industry and purge all the dirty elements by arresting them and sending out an anti-corruption directive. To the government official responsible at the Ministry of Culture and Sports, we say “Be more supportive of the businesses.” Now the investigation will end. Then, the new regime comes in power. Shall we shake things up again? An investigation once again. This could be problematic.

You've seen a lot of news articles that say, "the pro-Park faction is losing power." If it is discovered that civilians are involved in state affairs and the Ministry of Culture and Sports, with the revealing circumstances, we could have an investigation or national assembly committee hearing, couldn't we? The hearing will call Choi Soon-sil as witness, if we were to imagine the worst. If so, the people around Park will suffer a downfall. It would be a collapse.

Within the Saenuri Party, Park’s people and the opposition are fighting over the share of political control in order to seize power. By siding with the non-Park faction instead of Park’s people, we use this as a device to kill Park, and once the power is transferred to a new regime, they may perhaps get a seat in the new government?

After making a deal with Young-tae, even if she is not the chairperson, the director will die because Park Geun-hye becomes a lame duck. What makes this far worse is that Young-tae, the minister or Coach Cha light the fire so as to burn down the pro-Park faction and remove their power. This leads to the next presidential candidate becoming a non-Park candidate. That's where I get a position from.

If you see what happened then, you do an interview and you appeared. You did not do it so you cut the tail and leave. The next is (Ko) Young-tae. Cut the tail and get out. Finally, director Choi. Interfering in state affairs? This will not go away easily. Choi will be dragged into that. Presently, she does the work of Park Geun-hye administration - then ridiculous Choi Soon-sil and Jung Yoon-hui are involved in the state affairs? These are the steps it would take.

There are some companies. (Several) Find some and send Director Cha and Kim-jong, then we would take control of the (MIR) Foundation. 

I said it is hard to do it in Korea. (Ryu, Sang-young) We need to be able to control from overseas. Young-tae should steer it.(Kim) And get the overseas business license, who cares about what happens overseas? We  just do it. (Ryu) In fact, it is from Myanmar that can happen quickly.

To be honest, we said the same for the Foundation. Take control of him. (Ko Young-tae). The chairperson needs to go in but (Ko) Young-tae said it would be hard at that time. I do not agree with the idea of the director that (Ko) Young-tae should hire the employees for Mir. We just put someone we control and have that person be a secretary general and the chairperson is someone who rubberstamps. Then we catch someone who is really political and make a deal with that person.

We say “I'll give you one seat’ and seat people one by one. If we appoint a politically leaning person as the chairperson, that person won’t follow what we say when we become weak and would betray us. You should not do that.

At this moment, we just hire some boring, 'yes man' and ask that person to get a salary and rubber stamp what we want to do and tip us if you have human intelligence, so and so, it would be perfect. The chairperson of this foundation wanted to go on his own. That person is simply not qualified. It is surprising the foundation is still running.

MBC News exclusive -  the recordings were released in a show called “Choe Soon-sil is a setting sun”. On today’s episode, it is revealed that Go Young-tae was called "G Bul-gu" or "Big Liar".

At the time of the conversation, Ryu Sang-yeong began working as the director of The Blue K while remaining the CEO of their own secret company, “Ye Sang”.

Unlike the recorded files and transcripts that have been released so far, the repercussion of this release would be expected to be far greater, so we should stay tuned for the further development in the prosecution and public opinions. Particularly, the court ruled that the recording files are not direct evidence to the case, so they are not the material evidence. However, the judge admitted the transcripts and recordings are evidence and will review the contents. Let us wait and see what happens.

Court ruling on Former President Park Geun-hye on the 6th April 2018

[Decision with No Mention of the Tablet PC]

Extending her arrest, onerous trial schedule, live broadcast of the the sentencing...The Judge Kim Se-yoon, the name which will live in infamy.....

The court not only failed to mention the "tablet PC" in the 2-hour long broadcast of the district court sentencing on the 6th from 2:10 pm. It also made no reference to it in the press release distributed to legal reporters. Prosecutors have argued that the tablet PC which was submitted by JTBC is the central evidence that proves the charge that Park Geun-hye leaked state secrets. However, according to the results from the National Forensic Service (NFS), the tablet PC was used by more than one user and there was no document editing program for speeches. Also, the photo of Ms. Choi Soon-sil's nephew had been planted improperly. The public had a great interest in whether the court would admit the tablet PC as evidence. Defence counsel Lee Kyung-jae's written statement was announced when the court ended the live broadcast without mentioning the tablet PC at all. By the way, it was discovered that the tablet PC was mentioned in the court opinion in an exclusive report by JTBC in the evening that day. Presiding Judge Kim Se-yoon chose the approach of excluding all the media except JTBC in order to admit the tablet PC which was allegedly owned by Choi Soon-sil, but with little evidence to prove it, so that Ms. Park could be charged with revealing state secrets. -  Notes by Editor ---------------------

Defence counsel for Choe Seo-won (aka Choe Soon-sil), Lee Kyung-jae, criticized Judge Kim Se-yoon by quoting a maxim, Yuchuimannyun (유취만년 A bad name will live in infamy for thousands of years.)

On the 6th, Lee Kyung-jae, told Judge Kim Se-yoon, who sentenced Park Geun-hye to a lengthy, 24-year imprisonment, that "I fear that the name of the judge will live in infamy for thousands of years because of this ruling and his live TV broadcast."

Mr. Lee strongly criticized the court for not mentioning the tablet PC that was submitted by JTBC as evidence, even though the court found Ms. Park guilty of disclosure of state secrets in the course of official duty.

Mr. Lee pointed out that, "The trial court delayed for nearly a year the verification and testimony of the JTBC's tablet PC, which is the central evidence for the fabricated allegations for interference with the state affairs, and later the court failed to mention the tablet PC even though it admitted into evidence the forensic report from the National Forensic Service (NFS). These make the court's decision grossly unjust."

With regard to this, Mr. Byeon Hee-jae, CEO of Media Watch, said the Evidence of Impeachment motion put by the National Assembly on December 8, 2016 only included 21 unverified news reports written by JTBC and other newspapers. He also stressed that it was the planting of false evidence in the tablet PC that led to the search and confiscation of The Blue K, and the detention of Jeong Ho-seong and Ahn Jong-beom, which were a fraud and this was a politically orchestrated impeachment.

Mr. Byeon said if the forensic report on the tablet PC by the National Forensic Service (NFS), admitted as evidence by Kim Se-yoon, says that JTBC has not planted or doctored anything in the tablet PC and the tablet PC scientifically belongs to Choi Soon-sil as alleged by Son Seok-hee and JTBC, there would be no reason not to admit it as evidence for this trial. He also asked why the part that "She edited the speech on the tablet PC" was missing if the JTBC reports were true.

The following is the full transcript of the statement by defence counsel Lee Kyung-jae in response to the district court ruling.

On the grave errors related to the sentencing by the district court of former president Park

April 6 2018. Lee Kyung-jae, esq., Dongbukah LLP

1. The 22nd criminal department of the Seoul Central District Court (Judge Kim Seo-yeon) sentenced former president Park to 24 years in prison and a fine of 18 billion won for her alleged interference in state affairs.

·        As this sentencing was already anticipated when presiding judge Kim Se-yoon sentenced Choi Seo-won to 20 years in prison with a fine of 18 billion won in February 13, 2018, there is nothing new.

·    The legal ground for this sentencing by judge Kim Se-yoon was mere reference to the reasons for the related cases such as Choi Seo-won and defendants Kim Jong and Cha Eun-taek.

·      If there is a conspicuous point in this sentencing, it would be the exaggerated and harsh rebuke for former president Park stated in the reasons for sentencing.

2. A major error in the course of proceedings and sentences up to the sentencing of this case.

(1) Prolonged, Arbitrary Arrest and Improper Interrogation

·     In this case former president Park was sentenced on March 31, 2017 after almost one year in detention after her arrest.

·       From the beginning, the interrogation was not feasible within the six month period given by the arrest warrant.The court then unlawfully issued a new arrest warrant at the end of six months, before the old warrant had expired. Such unlawful extension of detention violates the principle against arbitrary prolonged detention under UN Human Rights rules.

·      Former president Park refused to appear in court for the presiding judge's sentencing based on the erroneous application of law, leading to the trial being crippled. Such a crippled trial was entirely due to Judge Kim Se-yoon's fault. He followed only the superficial formalities of procedural due process, and turned a blind eye to the principle of protecting human rights laws relating to the arrest and detention period in criminal procedures.

(2) Proceedings that Amount to Physical Pain

Presiding Judge Kim Se-yoon pressed on with three to four trials a week as he was running out of time in the detention period, during the trial of former president Park. The defendant's life and health were not his interest. Judge Kim's trial conduct shows that he treated Park as simply an object to be judged or a means to achieve his objective of trial. Although she stands before the court as a defendant, the defendant is a subject of criminal procedure, and her proper rights, dignity and honor as a human should be respected. However, none of the proceedings in this trial were based on such principles.

(3) Conspiracy with Choi Seo-won and the Evidence for it

·        There is no direct evidence that Park conspired with the defendant, Choi Seo-won (particularly in regard to bribery).

·        In addition, the court and the prosecution acknowledged that Park received no gain in relation to this. If it accepts this, the court had to look at whether there was a significant motive for Park to commit the crime of bribery for Choi Seo-won or her daughter despite impeachment, arrest, and harsh punishment, but the court didn't consider this at all. There is no serious crime without a criminal motive. Moreover, bribery is not an impulsive or heat-of-the-moment crime.

·     As in the case of Choi Seo-won, the evidence of conspiracy only includes ① number of phone calls and ② some words scribbled in former Senior Presidential Secretary Ahn's notebook. Other points are nothing but conjectures and speculations. In fact, there were evidentiary documents and facts which are more persuasive, proving they were not bribes. However, when there was uncertainty, the ruling was in favor of the prosecution and not the defendant.

3. Illegality of the Live TV Broadcast of the Sentencing by the Court

(1) Judge Kim Seo-yoon flatly denied Park's refusal to participate in live broadcasts, and broadcast the hearing live, giving the reason of "being in the public interest".

(2) The judge justified this by citing the "public interest" of satisfying the "people's right to know." However, this was a public trial, and even if it was not covered live on TV, reporters from the press reported the entire trial process and its news, inside and outside Korea, in real time. In that sense, " the people's right to know" is not the same as live TV broadcasts, and satisfaction of "the people's right to know" is not a just reason for this.

(3) The areas of public interest that the judge should serve are that ① the defendant's human rights are respected in criminal proceedings and the principle of presumption of innocence is observed and ② the trial was not held in camera by a presiding judge or a public prosecutor, in order to administrate judicial justice through a fair trial.

·        The reason for not broadcasting the running of prisons is to respect the basic human dignity of the prisoners, rather than the general deterrence effect.

·        As this is the case for the convicted defendant, it is abhorrent for the district court trial of a political case in which the innocence of the defendant is highly contested, to be commented on by the presiding judge on TV, with his comments then being aired in Korea and abroad. Given the mass media's ripple effect and sensational impact, presumption of innocence for former president Park and her accomplices was no longer available in the public's view.

·      Thus, the presiding judge failed to secure the following principles of criminal procedure and thereby hurt the public interest of justice:

① Respect for the human rights of defendants

② Principles of presumption of innocence

·      In other trials relating to interference in state affairs, the judge himself or other court judges have never broadcast the trials for the reason of public interest, without the consent of the defendant, and the media did not raise any objection to this. Even in this case, the media made no request to the court to broadcast the trial live without the defendant's consent.

(4) Eventually, this TV live broadcast was a measure to unilaterally proclaim the presiding judge's rationale for the sentencing for his benefit only, and it has the effect of making it a matter of fact by impressing the district court trial on people's mind and condemning former president Park and her sentence to harsh punishment, even though her guilt or innocence had not yet been decided.

4. Final Words

·       The fact that the authentication of JTBC's Tablet PC evidence was delayed for nearly a year, though it was the central evidence of the allegation of the fabricated interference of state affairs, and the fact that the court failed to mention the tablet even though its forensic report was admitted as evidence, show that the sentencing was unjust.

·      It is expected that this case against Park will become a model of a "mis-trial" that will go down in history, contrary to the intent of the judge, for all the wrong reasons.

·     The judge speaks in and is responsible for the sentencing. I am very concerned that this sentencing by the judge and the live broadcast on TV may have brought infamy onto the judge.

Ko Young-tae, the male prostitute who f...ed Korea

I wrote that the Tablet PC was a smoking gun in my previous post. The whole scandal, actually, started because one of the Ko Young-tae’s cronies had a pending issue about money owed to a large pharmaceutical manufacturing company as a result of a marketing promotion event.

Lee Seung-han (이승한), formerly General Manager of Mir Foundation, ran a service company that once organized a Marketing promotion for Han-mi Pharmaceutical Company by inviting several hundreds of doctors and nurses to a resort in Gang Won Do.

During the marketing promotion, Lee obtained a data base of tens of thousands of doctors and nurses and provided the data to Han-Mi.

In return, he asked for 30억원 (300,000K won = $US2.7 million). Han-mi refused, saying the requested amount was  ridiculously high, and told Lee to take them to court if he  wished. 

Lee contacted Ko Young-tae (a one time lover of Choi Soon-sil), whom he got to know via Director Cha Un-taek, and asked for help.  Lee told Ko that if he could get the money back, he’d give him 5억원 (US$450k).

Ko Young-tae contacted Choi Soon-sil,thinking that Choi had big power associated with President Park. Choi flatly refused. According to reporter Woo Jong-chang, Park had never helped Choi's private business, and Park didn't have any idea that Choi was associating with Ko Young-tae. Nevertheless, the allegation that Choi embezzled money from the non-profit organization also turned out to be false. The money is still there.

(NB:  Woo Jong-chang, a highly respected investigative journalist, has been  following this scandal in depth from the beginning,  He is also the first to break the news of the controversial phone recordings of Ko and his gang plotting the overthrow of Park since 2015.)

Based on the above facts, he probably had a grudge against Choi. So he approached a journalist for money with the information that Park often asks Choi's opinion on her presidential speeches. The journalist immediately recognized that this is a great opportunity for a news story.

And a high ranking prosecutor who is connected with the opposition party was also approached.

I will post a transcript of phone recordings made by Kim Soo-hyeon (one of  Ko’s cronies who apparently didn’t trust Ko so he recorded every conversation he, Ko and others had for future insurance). The voice recordings reveal the plot to frame and remove Park.

Tablet PC - UPDATED

UPDATE 1:  More lies from Sohn Seok-hee.  The court on the 6th April 2018 never mentioned a word on Tablet PC, but JTBC broadcast that the Court acknowledged the Tablet PC belongs to Choi Soon-sil.

Sohn Seok-hee, Shim Su-mi (JTBC reporter) and Kim Pil-joon (JTBC reporter) are summoned to attend Court as  witnesses for  Choi Soon-sil's 2nd trial.

(7) The most deviant example is the tablet PC submitted by a TV station, JTBC. In the early stage of this case, JTBC's report of Ms. Choe's tablet PC on October 24, 2016, was so damaging as to bring down Park’s administration. The prosecution could not disclose the tablet PC until it reached determination stage.

Thanks to the presiding judge's courageous decision, in the Court last month, one year after the tablet PC was submitted, the NFS (National Forensic Service)'s authentication bulletin and 20,000-page analysis report on the tablet PC was submitted to the Court.

It revealed that the tablet PC submitted by JTBC was neither owned nor used by the defendant. It belonged to a former the Blue House administrative official, Mr Kim Han Soo and was used by others including Mr Kim Hui-jong (Secretary of Administration in former President Park's government), as confirmed by forensic analysis and related evidence. The controversial speech made on March 27, 2014 in Dresden, Germany has nothing to do with the defendant.

Although the prosecution could have discovered the level of contamination of JTBC's tablet PC as evidence, its ownership, its usage, and the illegality of how JTBC obtained it, the prosecution did not interrogate Mr Go Young-tae, nor Mr Kim Hui-jong , nor Mr Kim Pil-joon (JTBC reporter).

The illegal act of installing a CCTV at the presidential dressing room was not examined. Mr  Park Won Oh and Mr. Noh Seung Il, who stole the data from Defendant Ms Choe Seo Won's desktop computer and Core Sports company in Germany, have been given protection instead of being under investigation. - Lawyer Lee Kyung-jae

A private tablet PC containing over 200 presidential documents was seen by many as the smoking gun that proved the alleged outside interference in state affairs and led to President Park Geun-hye's ousting.

Park's confidante Choi Soon-sil was identified as its owner by JTBC, the TV network that claimed it had obtained the PC.

Sohn Suk-hee, the head news anchor and president of JTBC, is the main culprit responsible for fabricating the tablet accusations, and for instigating people's anger by spreading fake news. Korean conservatives call him Korea’s Joseph Goebbels (Nazi propaganda minister).

JTBC first said they found the PC used by Choi Soon-sil. JTBC later announced that it is the tablet pc, not a PC, and it was found in the trash can of Choi's second home in Germany.  JTBC claimed it contained the classified information.

People (conservatives) began to suspect that the tablet might be a fake, and fabricated news, as it was never shown to the public. The JTBC changed their story, saying that it was found in Ko's office, not in Choi's home rubbish in Germany. To divert the people's attention from the fake tablet, the Special Prosecutors announced that they had found another Samsung tablet belonging to Choi at her abandoned home in Seoul. This was said to contain the information about a corrupt deal between Choi/Park and Samsung. And they said it had been used since 7/25/15, when the Samsung deal was cut.

But this was found to be a lie, because the Samsung S2 tablet was not released to the public for sale prior to 8/25/15!

During the trial, the defence team and Choi Soon-sil wanted to see the Tablet PC, and requested the court to use it as evidence.  However, the court did not allow the Tablet PC as evidence. The prosecutors and the court kept denying the request to view the PC, citing various reasons. The truth is that they couldn’t afford to let the defence team look at the PC because then it would be revealed as fake/tampered with evidence and the whole case against Park Geun-hye and Choi Soon-sil would collapse.

After many requests from lawyer Lee Kyeong-jae, the court allowed the National Forensic Service to view the tablet (국립과학수사연구원) and they analysed and released a report on the 27^th November 2017. 

According to the report:

1.  The report consists of 20,000 pages.

2.   The NFS couldn’t come up with any evidence that the Tablet PC has been used by Choi Sool-sil.  

3.  There are many indications that the tablet PC had been used by many people including Kim Hui-jong (administrative officer at BH), and that the real owner is Kim Han-su (secretary to the president for administration). Recently, it was exposed by reporter Woo Jong-chang that Kim Han-su is a close friend of Hong Jeong-do, the CEO of JTBC, and a son of JoongAng press.

Reporter Woo recently broadcast via his channel – Woo Jong-chang’s Truth and Lie:  the Mountain of Lies that Buried President Park -  Kim Han-su is a close friend of Hong Jeong-do, the CEO of JTBC, and the son of JoongAng press.  He also revealed that Hong Seok-heon, the owner of JoongAng and JTBC, isthe one who gave the Tablet PC to Sonh Seok-heon.

4.  Yoon Seok-yeol, one of the key prosecutors, said they concluded that it belonged to Choi, based on the fact that GPS locations stored in the device matched Choi's whereabouts.  Yoon claimed that the Tablet PC with her at the time she was at JeJu Airport in 2012  The Tablet PC was 50km away from JeJu Airport, the NFS report states.

5.  The Tablet PC doesn’t have a programme which would allow editing of the Dresden Speech. Choi could not have done this. This is the most important finding as this reflects on whether or not Choi edited President Park's speech - the very thing that most angered the public.

6.  JTBC obtained the Tablet PC on the 18^th October 2016 and kept it till 24^th October. During this period, 3000 files were deleted or added. The National Forensic Service report shows the changes made by day and hour. However, the prosecutors announced and the media broadcast that the Tablet PC was never fabricated, on the very same day the NFS report to the contrary came out.
